Sponsoring a Waiter Through the Premium Dining Labour Agreement: A Path Less Known

 

A restaurant client approached us with a challenge—they wanted to sponsor one of their experienced waiters, but quickly discovered that “waiter” is not on the standard list of eligible occupations for common visa types like the 482 or 407.

On the surface, it seemed there was no pathway available. However, after carefully reviewing the nature of the business and the role, we found a solution that many are unaware of.

The restaurant was a premium dining venue, which meant it qualified for the Restaurant (Premium Dining) Industry Labour Agreement. This special labour agreement allows eligible high-end restaurants to sponsor overseas workers in certain roles—including trade waiters—for up to four years, and even for permanent residency.

We guided the restaurant through the labour agreement process and helped prepare the nomination for the waiter position under this stream. The agreement has set, non-negotiable terms, but for businesses that qualify, it creates a rare pathway to bring in front-of-house talent that’s otherwise ineligible.

Thanks to the premium dining labour agreement, the restaurant was able to retain a valued team member and the waiter was able to continue building a long-term career in Australia.
