Emily, an Australian citizen, wanted her husband, Chinedu, to be granted an Australian visa so they could finally live together in Australia. Chinedu was living in the Philippines, and being married couple, living apart was very stressful.

Emily was determined to build a life with her spouse here in Australia. After reviewing their situation, we advised them to apply for a Partner (Subclass 309/100) visa, which allows a married partner of an Australian citizen to live in Australia. The Department of Home Affairs needs to be satisfied that the couple are in a genuine relationship, even if they are married.

We worked closely with both Emily and Chinedu to prepare a strong, customised partner visa application. Under our guidance, they gathered evidence of their relationship, including their marriage ceremony; frequent remittances to the Philippines; visits to the Philippines to be together; photos of them together and with others; statements about their relationship written by each of them and by others; and ongoing communication while living apart. With everything in place, the visa was lodged—and after several months,, Chinedu’s Subclass 309 visa was granted.

Now, Chinedu has arrived in Australia, and the couple is finally living under the same roof and planning their future together. Two years from the lodgement date of the 309/100, Chinedu can lodge his Subclass 100 visa, which is a Permanent Residence visa.
